Abstract
The book offers a wide, critical-systematic analysis of the measures of prevention of the so-called global crimes (such as international terrorism, human trafficking, corruption etc.). The main focus falls on the "negative measures", that is, restrictions of individual rights and freedoms to preventive purposes applicable even before a crime has been committed (so called "praeter delictum" measures). The objective of the volume is to offer a first global and systematic framework of the local and supranational models of crime prevention, in the attempt to establish a common set of safeguards of a non-suppressable nucleus of fundamental human rights: special attention is paid to the decisions of local and international courts in a perspective of judicial globalisation. The first chapter offers an introduction to the problem of the relation between negative measures and punishment. The second chapter trace the most recent developments of crime prevention in contemporary legal orders, proving the increasing tendency to recur to negative and emergency measures to prevent (and repress) at least some "special" forms of criminality. The third chapter illustrates the main national models of crime prevention, while the last chapter is dedicated to the analysis of supranational and international models of crime prevention (especially those of the EU and of the UN).
