Abstract

This chapter critically evaluates the structure of English and Welsh personal insolvency law and the problems that this structure gives rise to for consumer debtors. It is argued that the Debt Relief Order (DRO) refroms have provided a solution for consumer debtors but one which essentially only dilutes the underlying problems with personal bankruptcy as a method of debt forgiveness.
